By allowing your student to be enrolled in this program you, the parent or guardian, indicate your acceptance of and agreement to all of these Program Terms.

You agree that La Michoacana Purépecha LLC may change, add, or eliminate any Program rewards or benefits, or participating locations; or change or end any feature of the Program; in whole or in part, at any time, and without notice or compensation.

Program Membership Qualifications and Registration.
To be eligible to enroll, you must be a K-8 student and have parent or guardian permission. Registration takes place in store. We will ask for basic information about the student and collect parent or guardian signature for approval.

Earning Program Points, Rewards and Prizes
•This program is only valid at La Michoacana Purépecha.
•Each student is eligible to collect one sticker and one free kid’s cone per quarter or trimester when they show that quarter or trimester’s grades.
•All courses or classes should have B+ or equivalent grading or marks. We basically want to know you are working above average on your schooling. If you are not sure if your child qualifies, ask in store.
•You must claim that quarter or trimester’s sticker and ice cream cone before the next quarter or trimester grades come out.
•No purchase is necessary to enroll or remain in the program or to claim your free kid’s cone if you meet the requirements above.
•if you miss a quarter due to not meeting the grades requirement or for another reason, just come back the following quarter when your grades improve or anytime in the future – just bring your student passport back if you meet requirements for a new sticker.
•As you accumulate stickers, we may give additional prizes along the way beyond your free kid’s cone.

Disclaimers.
•You need to keep your student passport safe -- we may replace it, but you will lose your accumulated stickers.
•La Michoacana Purépecha is not responsible for lost or stolen passports or stickers.
•The stickers or student passports have no cash value.

Your Right to Terminate Your Participation in the Program.
•You may terminate your participation in this program at any point.

Indemnification.
•By participating in the Program, you agree to release La Michoacana Purépecha and all of their respective affiliates, parents, subsidiaries, franchisees, vendors and suppliers, and each of their officers, directors, employees and agents from any and all liability, loss or damage incurred through your participation in the Program including, but not limited to, the earning of points, and the receipt, possession, redemption, use and/or misuse of stickers, student passports or prizes received.

Governing Law.
•These Program Terms and any disputes arising under or related to them will be governed by United States federal law and the laws of the State of Minnesota, without reference to a state’s conflict of law principles.

Changes to these Program Terms.
•La Michoacana Purépecha may amend or replace these Program Terms at any time. Amended terms will be posted to our website at www.lamichoacanapurepecha.com. As permitted by applicable law, any amendment or replacement will become effective at the time La Michoacana Purépecha posts the amended or replaced Program Terms to the website. Your continued participation in this Program will constitute your acceptance to any amendment to or replacement of these Program Terms.

Force Majeure.
•La Michoacana Purépecha LLC is not responsible or liable to you, or any person claiming through you, for failure to supply or fulfill an award, benefit or points in this Programs in the event any Program or its operations are affected by any acts of god, any action, regulation, order, or request by any governmental or quasi-governmental entity, equipment failure, actual threatened terrorist acts, weather, natural phenomenon, war (declared or undeclared), fire, embargo, labor dispute or strike, labor or material shortage, transportation, interruption of any kind, civil disturbance, insurrection, riot, or any laws, rules, regulations or orders or other action adopted or taken by any national, federal, state, provincial, or local government authority, or any other cause, whether or not specifically mentioned above.

Entire Agreement.
•These Program Terms constitute the entire and exclusive agreement between you and La Michoacana Purépecha LLC with respect to the Program. These Program Terms supersede all prior or contemporaneous communications, agreements, advertising, descriptions, terms and conditions, and proposals, whether electronic, oral, or written, with respect to the Programs. You acknowledge that you not been induced to enter into these Program Terms by any representations or promises not specifically stated in these Program Terms.
